NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF GLYNN Under and by virtue of the power of sale contained with that certain Security Deed dated July 17, 2018, from Edward W. Ophardt and Paula M. Ophardt to Mortgage Electronic Registration Systems, Inc., as nominee for Acopla, LLC., recorded on July 31, 2018 in Deed Book 3925 at Page 127 Glynn County, Georgia records, having been last sold, assigned, transferred and conveyed to Nationstar Mortgage LLC d/b/a Mr. Cooper by Assignment and said Security Deed having been given to secure a note dated July 17, 2018, in the amount of $150,505.00, and said Note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Glynn County, Georgia, on December 3, 2019 the following described real property (hereinafter referred to as the "Property"): ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING ON BLYTHE ISLAND THEREIN IN THE 27TH. BLISS, REGISTERED SURVEYOR NO. 13 ON APRIL 14, 1965, SAID PLAT BEING ATTACHED TO THE AFORESAID CONVEYANCE AND REFERRED TO HEREIN FOR ALL PURPOSES AND THE PROPERTY HEREIN CONVEYED BEING MORE PARTICULARLY DESCRIBED ACCORDING TO SAID PLAT AS FOLLOWS, TO-WIT: TO LOCATE THE BEGINNING POINT START AT THE INTERSECTION OF THE NORTHERLY LINE OF PARLAND ROAD WITH THE WESTERLY LINE OF BLYTHE ISLAND DRIVE AND FROM SAID POINT, RUNNING THENCE NORTH 58 DEGREES 25 MINUTES WEST ALONG THE WESTERLY LINE OF BLYTHE ISLAND DRIVE A DISTANCE OF 456.6 FEET TO A POINT; SAID POINT BEING THE NORTH LINE OF A 50 FOOT STREET (CHERRY LANE); THENCE RUNNING SOUTH 61 DEGREES 50 MINUTES WEST FOR A DISTANCE OF 452 FEET TO A POINT WHICH IS THE POINT OR PLACE OF BEGINNING OF THE TRACT HEREIN CONVEYED; AND FROM BEGINNING POINT CONTINUE THENCE SOUTH 61 DEGREES 50 MINUTES WEST A DISTANCE OF 100 FEET TO A POINT; THENCE NORTH 28 DEGREES 10 MINUTES WEST A DISTANCE OF 204.9 FEET TO A POINT; THENCE NORTH 66 DEGREES 15 MINUTES EAST A DISTANCE OF 100.2 FEET TO A POINT; THENCE SOUTH 28 DEGREES 10 MINUTES EAST A DISTANCE OF 200 FEET TO THE POINT OR PLACE OF BEGINNING. THE PROPERTY HEREIN CONVEYED IS FURTHER DESCRIBED AND IDENTIFIED ACCORDING TO AN UNRECORDED PLAT OF BLYTHE ISLAND SUBDIVISION, SECTION "B, BLOCK "C", MADE BY C. H. BLISS, REGISTERED SURVEYOR NO. 13 ON JUNE 25, 1965, AND SAID PROPERTY BEING DESIGNATED THEREON AS BLYTHE ISLAND SUBDIVISION, SECTION "B", BLOCK "C", LOT NO. FIVE (5). The debt secured by the Security Deed and evidenced by the Note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys' fees. Notice of intention to collect attorneys' fees has been given as provided by law. To the best of the undersigned's knowledge, the person(s) in possession of the property is Edward W. Ophardt, Paula M. Ophardt. The property, being commonly known as 144 Cherry Lane, Brunswick, GA, 31523 in Glynn County, will be sold as the property of Edward W. Ophardt, Paula M. Ophardt, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
