Notice of Sale Under Power Glynn County, Georgia Under and by virtue of the Power of Sale contained in that certain Georgia Security Deed and Security Agreement given by Wedac, LLC ("Grantor") to Branch Banking and Trust Company ("Lender") dated June 23, 2010 and recorded June 29, 2010 in Deed Book 2733, Page 162, Glynn County, Georgia official records, as affected by that certain Modification Agreement to Georgia Security Deed and Security Agreement dated May 30, 2013 and recorded June 12, 2013 in Deed Book 3175, Page 176, aforesaid records, and as further affected by that certain Modification of Security Deed dated March 24, 2017 and recorded May 12, 2017 in Deed Book 3741, Page 96, aforesaid records (together with any and all amendments or modifications, hereinafter collectively referred to as the "Security Deed"), conveying the property described below to secure repayment of that certain Promissory Note dated June 23, 2010 made payable by Grantor to the order of Lender in the stated principal amount of $475,000.00, together with interest thereon as set forth therein (together with any and all prior notes, amendments or modifications, hereinafter collectively referred to as the "Secured Indebtedness"), there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Glynn County, Georgia (or at such other location as may be lawfully designated in Glynn County for conducting sheriff's sales and/or public foreclosure sales), within the legal hours of sale on the first Tuesday in September 2019 (being September 3, 2019) the following described property located in Glynn County, Georgia, together with all improvements, personal property, fixtures, easements, hereditaments, rights, members, and appurtenances located thereon and described in the Security Deed (collectively, the "Property"): All that tract or parcel of land situate, lying and being on St. Simons Island, in Glynn County, Georgia, and being Building D/Unit 100A of Demere Village Medical Center Condominium, containing 3,158 square feet, as shown on the plat of survey by Joe Biletzskov, Georgia Registered Land Surveyor No. 1672, for Demere Village Medical Center Condominium, Demere Road, St. Simons Island, Glynn County, Georgia, dated December 3, 1986, a copy of which is recorded in Plat Drawer 19-A, as plat number 1324, in the Office of the Clerk of the Superior Court of Glynn County, Georgia, and as shown on the plans by William P. Hooker, Georgia Registered Architect No. 2887, for Demere Village Center Condominium, Demere Road, St. Simons Island, Glynn County, Georgia, dated April 2, 1986, April 7, 1986, and May 1, 1986, a copy of which is recorded in Condominium Plans File Number Book 4, Page 1081, aforesaid Records, as amended to shown Building D/Unit 100A and Building D/Unit 100B by plans by said William P. Hooker, dated July 15, 1998, and recorded in said records in Condominium Plans File Number Book V, Page 1414. The Unit is part of the property described in "Exhibit A" to the Declaration of Condominium for Demere Village Medical Center Condominium, dated December 16, 1986, and recorded in Deed Book 28-M, Page 467, as amended, the latest amendment to divide Building D/Unit 100 into Building D/Unit 100A and Building D/Unit 100B, said amendment dated July 24, 1998, and recorded in said records at Deed Book 472, Page 249, aforesaid Records. The Unit includes an undivided 11.424 percent interest in the common elements of Demere Village Medical Center Condominium (as such common elements are defined in said Declaration), together with all the right, title and interest of Grantor in said Unit and the appurtenances thereto under said Declaration. The above-described plat, as amended, and the Declaration of Condominium, as amended, are incorporated herein by reference and made a part hereof. As the Secured Indebtedness remains in default, the sale will be made for purposes of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorneys' fees (written notice of intent to collect attorneys' fees having been given).
