NOTICE OF SALE UNDER POWER GEORGIA, GLYNN COUNTY Under and by virtue of the Power of Sale contained in that certain Consumer Deed to Secure Debt from F. Arlene Kunda a/k/a Frances Arlene Kunda (the "Grantor") to Amos Financial LLC, as successor in interest to Synovus bank, a Georgia banking corporation, (f/k/a Coastal Bk of GA div Synovus Bank), formerly known as Columbus Bank and Trust Company, as successor in interest through name change and by merger with the Coastal Bank of Georgia ("Grantee"), dated November 2, 2000, filed and recorded November 8, 2000, in Deed Book 724, Page 640, Glynn County, Georgia Records, as assigned by that certain Assignment of Note and Other Loan Documents effective date June 27, 2018, filed and recorded July 16, 2018, in Deed Book 3916, Page 150, aforesaid records (as assigned, the "Security Deed"), conveying the after-described property to secure that certain Universal Note and Security Agreement dated October 26, 2017 from Grantor and Preston B. Kunda payable to Synovus Bank, in the original principal amount of Two Hundred Thirty Seven Thousand Four Hundred Forty Four and 46/100 Dollars ($237,444.46), with interest thereon as set forth therein (hereinafter the "Note"), there will be sold at public outcry to the highest bidder for cash before the courthouse door of Glynn County, Georgia, within the legal hours of sale on the first Tuesday in November, 2019, the following described property: All of that certain lot, tract or parcel of land, situate, lying and being in the 27th G.M. District, Glynn County, Georgia, and lving in that certain. subdivision known as LAUREL GROVE PLANTATION, described, and identified in that certain map and plan of survey prepared by James L. Conine, Georgia Registered Surveyor No. 1545, dated July 27, 1992, and-approved by the Board of Commissioners of Glynn County, Georgia in Plat Drawer 22, Map No. 39, and being ALL OF LOT 1, PHASE, LAUREL GROVE PLANTATION. Reference is hereby made to the above map and Plat of record for all and further purposes of description, identification and location of the real property hereby conveyed. Also conveyed is a non-exclusive easement for ingress and egress over all present and future private roads and ways which have been constructed within said subdivision as are currently shown upon the above referenced plat of Phase I or upon any future Plats of record of any other phases, extensions or additions to said subdivision: Any Portion of said lots which constituted marshlands within the meaning and definition of the Georgia Marshlands Protection Acts are hereby conveyed by quitclaim only. Said property is being conveyed subject to the utility and drainage easements as shown upon the recorded map and plan of said subdivision and the declaration of restrictions, conditions, limitation, reservations, easement, rights, privileges, etc., applicable to said lots in said subdivision as the same appear of record in the office of the Clerk of Superior Court of Glynn County, Georgia in Deed Book 4-A, Page 225. The indebtedness secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given as provided by law). The property will be sold for cash or certified funds and subject to that Security Deed from F. Arlene Kunda to Washington Mutual Bank, F.A. recorded in Deed Book 1338, Page 153, Glynn County, Georgia records, and any and all other matters of record superior to said Security Deed, outstanding ad valorem taxes, any matters which might be disclosed by an accurate survey and inspection of the property, zoning ordinances, restrictions, covenants, easements against the property, if any, and subject to any unpaid water and waste bills that constitute liens against the property, whether due and payable or not yet due and payable. The sale will be conducted as set forth herein subject to (1) confirmation prior to the sale that the sale is not prohibited under the U.S. Bankruptcy Code and (2) final confirmation and audit prior to the sale of the status of the loan with the holder of the Security Deed. Grantee reserves the right to sell the property in one parcel or as an entirety, or in such parcels as Grantee may elect, as permitted in the Security Deed.
