NOTICE OF SALE UNDER POWER GEORGIA, GLYNN COUNTY THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by PEDRO C. DURAN AND EVELYN DURAN Bank of the Ozarks, n/k/a Bank OZK, dated December 5, 2017 and recorded in Deed Book 3829, Page 288, Glynn County, Georgia Records, conveying the after-described property to secure a Note in the amount of SEVENTY NINE Thousand Dollars and 56/100 ($79,000.00) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Glynn County, Georgia, within the legal hours of sale on the first Tuesday in March, 2020 the following described property: All of that certain lot, tract or parcel of land situate, lying and being in the 27th G.M. District, Glynn County, Georgia described and identified according to that certain survey prepared by Atlantic Survey Professionals, certified by Ernest C. Johns, Jr., Georgia Registered Land Surveyor No. 2774, dated October 11, 2002, entitled "Minor Subdivision of a Portion of Lot 1, Little Oaks Subdivision", and being recorded in the Office of the Clerk of Superior Court, Glynn County, Georgia in Plat Drawer 28, Page 242, as ALL OF LOT NUMBERED FOUR (4), A PORTION OF LOT 1, LITTLE OAKS SUBDIVISION, GLYNN COUNTY, GEORGIA. Also conveyed herein by this deed is a non-exclusive easement for ingress and egress over and across Rodeo Road, a sixty (60) foot right of way and Tolar Lane, a sixty (60) foot private easement as designated and described in the above-referenced map and plat of survey prepared by Ernest C. Johns, Jr., Georgia Registered Land Surveyor No. 2774, and being recorded in the aforesaid records in Plat Drawer 28, Map No. 242. Subject to easements, restrictions, and covenants of record, if any. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in said Security Deed and by law, including attorneys' fees (notice of intent to collect attorneys' fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
