NOTICE OF SALE UNDER POWER GEORGIA, GLYNN COUNTY THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the power of sale contained in that certain Deed to Secure Debt given by Shashicka Tyre a/k/a Shashicka T Tyre Hill to Ameris Bank ("Lender") dated August 26, 2008 and recorded in Deed Book 2478, Page 263, Glynn County, Georgia records, as renewed, modified, amended, or otherwise restated by that certain Loan Modification Agreement dated November 29, 2010 and recorded in Deed Book 2807, Page 194, aforesaid records (together, the "Security Deed"), conveying the after-described property to secure that certain Promissory Note and Truth-in-Lending Disclosures dated August 26, 2008 in the original principal amount of $243,000.00, as last renewed, modified, amended, or otherwise restated by that certain Promissory Note and Truth-in-Lending Disclosures dated November 29, 2010 in the original principal amount of $235,617.61, as extended by that maturity extension agreement dated January 16, 2018 with a maturity date of April 1, 2018, as further extended by that maturity extension agreement dated March 27, 2018 with a maturity date of July 1, 2018 (together, the "Note"), the Security Deed and the Note as affected by that certain Forbearance Agreement dated July 25, 2018 (the "Agreement"), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Glynn County, Georgia within the legal hours of sale on the first Wednesday in January, 2019, the following described property: All that certain lot, tract or parcel of land lying and being in Glynn County, Georgia identified on that certain plat of survey prepared for Driggers Development, Inc., by Gary R. Nevill, Georgia Registered Land Surveyor No. 2401, entitled, "Final Plat for Eagle Crest, Phase Two", which has been recorded in Plat Drawer 29, Page 138 with the Office of the Clerk of Superior Court of Glynn County, Georgia identified as ALL OF LOT FORTY-NINE (49), PHASE TWO, EAGLE CREST SUBDIVISION. Reference is made to said plat for all further purposes of description. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note, Agreement, and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
