NOTICE OF FORECLOSURE THROUGH POWER OF SALE AND BY PUBLIC ADVERTISEMENT GLYNN COUNTY Pursuant to the Power of Sale contained in the Security Deed given by Donnell Smiley and Gwendolyn Smiley to James Davis, Jr. and Ruby Davis dated August 7, 2001, and recorded in Deed Book 820, Page 269 of the Office of the Clerk of Superior Court of Glynn County, Georgia, conveying the after-described property to secure a Note in the original principal amount of $46,800.00 with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Glynn County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on October 2, 2017 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property: All of that certain tract or parcel of land situate, lying and being in the 1356th Ga. Militia District, Glynn County, Georgia, containing one acre and being described according to a plat made by C.H. Bliss, GALS Number 13, on February 8 , 1966, a copy of which plat is attached to a Deed from Alma Coburn to James Davis, dated February 11, 1966, and recorded in the Office of the Clerk of Superior Court of Glynn County, Georgia in Deed Book 13-F, Page 184, as follows, to-wit: Beginning at the intersection of the western line of the Sterling-Pyles Marsh Road and the center line of a new twenty foot road dividing the property of Ardis Holton and the Ben Allen Estates, and from said point running thence South 8 degrees 6 minutes East along the Western line of the Sterling-Pyles Marsh Road a distance of 406.5 feet to the point or place of beginning of the property hereby conveyed , and from said beginning point continuing South 8 degrees 6 minutes East along the Western line of said Sterling-Pyles Marsh Road a distance of a 133.5 feet to a point; thence running South 79 degrees 21 minutes West a distance of 330 feet to a point; thence running North 8 degrees 6 minutes West a distance of 133.50 feet to a point; and thence running North 79 degrees 21 minutes East a distance of 330 feet to the point or place of beginning of the property hereby conveyed. LESS and EXCEPT any land taken in Deed Book 43-U, Page 6, as recorded in the Office of the Clerk of Superior Court of Glynn County, Georgia. Reference is hereby made to said map and plan and to the record thereof for all purposes allowed by law. The debt secured by said Security Deed has been and is hereby declared due, because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property is commonly known as 447 New Sterling Road, Brunswick, Georgia 31525 together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to: (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) unpaid water or sewage bill that constitute a lien against the property whether due and payable or not yet due and payable which may not be of record, (c) the right of redemption of any taxing authority, (d) any matters which might be disclosed by an accurate survey and inspection of the property, and (e) any assessments, liens, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
