NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by Timothy A. Hall and Christie M. Hall to Mortgage Electronic Registration Systems, Inc., as nominee for United Community Mortgage Services, Inc., its successors and assigns dated February 17, 2010, and recorded in Deed Book 2691, Page 236, Glynn County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Wilmington Savings Fund Society, FSB, as trustee for Upland Mortgage Loan Trust A, securing a Note in the original principal amount of $120,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, October 3, 2017, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All those certain lots and portions of those lots, tracts or parcels of land, situate, lying and being in Glynn County, Georgia being a portion of the original Day and Bloom Tract, Lots 11, 12, 13 and 14 and being further known as Bel Air Subdivision, as shown upon a plat of survey entitled Bel Air Subdivision prepared by Gene Pettigrew, Georgia Registered Surveyor No. 2094, and being more particularly described as follows, to-wit: To find the beginning point commence at the point of intersection of the southwesterly line of Todd Drive (a 50 ft. street located within Bel Air Estates Subdivision) with the southeasterly line of Lynn Street (a 50 ft. street located within Bel Air Estates Subdivision) and running thence south 28 degrees east along the said southwesterly line of Todd Drive for a distance of 230 feet to an iron pin; thence turning and running south 62 degrees west for a distance of 160 feet to a corner; thence turning and running north 28 degrees west for a distance of 230 feet to a corner of the on the southeasterly line of Lynn Street; thence turning and running north 62 degrees east for a distance of 160 feet to the point or place of beginning. Said property may be further identified as all of Lot 13 & 14, and the northeasterly 10 feet of Lot 11 and Lot 12, Bel Air Estates Subdivision. Said property is known as 154 Todd Drive, Brunswick, GA 31520, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor. The property is or may be in the possession of Christie M. Hall and Timothy A. Hall, successor in interest or tenant(s).
