NOTICE OF SALE UNDER POWER GEORGIA, GLYNN COUNTY Under and by virtue of the power of sale contained in the Deed to Secure Debt from Danita Michelle Matthews to Brian and Duke Properties, LLC, dated March 22, 2017, recorded in Deed Book 3720, page 476-490, Glynn County, Georgia, Superior Court Records ("Security Deed"), given to secure a Note for Danita Michelle Matthews to Brian and Duke Properties. LLC, dated March 22, 2017, in the original principal amount of $108,000.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash at the GLYNN county courthouse within the legal hours of sale on November 07, 2017, all the following real property: All of that certain lot, tract or parcel of land situate, lying and being in Glynn County, Georgia and in that subdivision well known as and called Beverly Shores Subdivision and being described according to a map and plat made by Atwood M. Freeman, on February 19, 1960, a copy of which is attached to that certain quitclaim deed from H.L. Cordell to Rudolph H. Ogden, dated March 4, 1960, which is recorded in the office of the office of the Clerk of Superior Court of Glynn County, Georgia (to which reference is hereby made for all purposes) as all of Lot One Hundred Fifty Four (154), Beverly Shores Subdivision, and being more particularly described as follows, to wit: Beginning at a point where the eastern line of Yorkshire Drive is intersected by the southern line of Nottingham Drive from said beginning point running North 19 degrees 13 minutes East for a distance of 60 feet across Nottingham Drive to the northern line of Nottingham Drive and thence turning and running North 70 degrees 47 minutes West for a distance of 15.6 feet to iron pin which mark the point of beginning of the property hereby conveyed; thence continuing along the Northern line of Nottingham Drive for a distance of 75 feet to an iron pin; thence turning and running North 19 degree 13 minutes East a distance of 134 feet to an iron pin; thence turning and running South 70 degrees 47 minutes East for a distance of 75 feet to an iron pin; thence turning and running South 19 degrees 13 minutes West for a distance of 134 feet to the place and point of beginning. Reference is hereby made to said maps and plans and to the record of each for further description and identification or said real property and for all other purposes. Also conveyed is a ten (10) foot easement for egress and ingress to Lot 154, Beverly Shores Subdivision, Glynn County, Georgia. The western line of easement shall run from Nottingham Drive at the intersection of the boundary line of Lot 153, Beverly Shores Subdivision and Lot 154, Beverly Shores Subdivision, along the western line of Lot 153, Beverly Shores Subdivision to the northern line of said lot. The purpose of this easement is to allow for access to the backyard of Lot 154, Beverly Shores Subdivision. Being the same property conveyed to Mark A. Blair by deed from Charlotte Mullis Ogden, recorded June 6, 2000, in Book 688, page 4. Property Address: 427 Nottingham Drive, Brunswick, GA 31525 The debt secured by said Deed to Secure Debt has been an is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. Because the debt remains in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Brian and Duke Properties, LLC holds the duly endorsed Note and is the current assignee of the Security Deed to the property. Brian and Duke Properties, LLC acting on behalf of and, as necessary, in consultation with Brian and Duke Properties, LLC (the current investor on the loan), is the entity with the full authority to negotiate, amend, and modify all terms of the loan. Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by ab accurate survey and inspection of the property, and (c) all matters of record superior to the Deed to Secure Debt first set out above, including, but not limited to, assessments, liens, encumbrances, zoning ordinances, easements, restrictions, covenants, etc. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the security deed. Pursuant to O.C.G.A. Section 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and non judicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided in the preceding paragraph.
